Potzus discharged on assault

A 37-year-old Yorkton woman has received a conditional discharge with 12 months probation related to an assault at a local nightclub last fall. Kendra Potzus pleaded guilty to one count of common assault on Monday in provincial court.

In a joint submission with the defence, the Crown, represented by Todd Wellsch told the Court that in the early hours of the morning on October 25, Potzus entered the City Limits Inn after an evening of drinking with friends and saw her husband, with whom she was going through a separation, sitting with some other people at a table. She went over to a woman at the table, slapped her and pulled her hair screaming the woman had wrecked her life, the prosecutor said.

He noted that Potzus had no prior criminal record in recommending the discharge to the judge. In addition to the statutory conditions, her probation order would include requirements to undergo assessment and treatment, if warranted, for addictions and anger management. There would also be a clause that she has no contact with the victim.

The defence, represented by Regina attorney Michael Tocher, characterized the incident as “impulsive” and “out of character” and suggested as assaults go, it was on the “low end of the scale.”

He said his client takes full responsibility for her actions and cited the early guilty plea as a mitigating factor.

Judge Patrick Koskie noted he is obligated under instructions from the Court of Appeals to accept joint submissions if finds them within reason. He said he did not find the recommendation unreasonable given the defendant’s lack of record and the nature of the assault.
